Terms of service.
Plain English.

The rules for using the cutthewaffle.nz website and reading the content on it. Separate from any contract you sign as a client, which has its own Services Agreement and Statement of Work. NZ law governs both.

Heads up: These terms cover the website and its content. Paid client work is governed separately by the Services Agreement and Statement of Work that you sign before the project starts. If you're a client, your contract overrides anything here that conflicts with it.

1. Who these terms apply to

These terms apply to anyone using cutthewaffle.nz ("the site") and the content published on it. By visiting, reading, or submitting a contact form, you agree to these terms. If you don't agree, stop using the site.

2. Who I am

The site is operated by Ben Harris, trading as Cut the Waffle, based in Auckland, New Zealand. Contact: hello@cutthewaffle.nz.

3. What's on the site

The site advertises B2B marketing services (SEO, AEO, AI setup, interactive tools, sales decks, brand systems) and publishes a blog called "The Cut". The content is for general information and to help potential clients decide whether to work with me.

The blog isn't professional advice

Articles on The Cut share opinions, frameworks, and observations from my experience. They are general guidance, not a substitute for tailored advice on your specific situation. If your business depends on a decision, get bespoke advice (from me or anyone else) before acting on it.

4. Intellectual property

What I own

  • All website content, including blog posts, images, illustrations, SVGs, copy, structure, schema, code, and the "Cut the Waffle" brand and name, is owned by me unless explicitly stated.
  • Logos, trademarks, and brand assets of third parties shown on the site (Author-it, FUJIFILM, Occasion Co, etc.) remain owned by those companies. They're shown with permission or under fair use as portfolio examples.

What you can do

  • Read, share, link to, and quote the content for non-commercial purposes, with attribution and a link back to the original page.
  • Reference our frameworks and ideas in your own work, with credit where useful.
  • Use AI engines (ChatGPT, Perplexity, Claude, Gemini, Google AI Overviews) to cite the content. That's the whole point. The site has /llms.txt and robots.txt configured to welcome AI crawlers.

What you can't do

  • Republish full posts on another site without written permission.
  • Scrape, mass-download, or commercially redistribute the content.
  • Pass off the content, frameworks, or brand as your own work.
  • Use the "Cut the Waffle" name or logo for any commercial purpose without written permission.

5. Acceptable use

Don't:

  • Attack, scan, or attempt to gain unauthorised access to the site or its infrastructure.
  • Submit malicious code, malware, or spam through any form.
  • Use the contact form for anything other than a genuine enquiry.
  • Impersonate me, Cut the Waffle, or any client mentioned on the site.
  • Use the site in any way that breaks NZ law or the law in your country.

6. Contact form and enquiries

Submitting an enquiry through the contact form (or by email) doesn't create a contract or client relationship. It starts a conversation. A client relationship is established only when both parties sign a Services Agreement and Statement of Work, and the first invoice is issued.

I aim to respond to all genuine enquiries within one business day. I may decline to take on any project for any reason - usually because of fit, capacity, or timing.

7. Pricing on the site

Indicative price ranges are published on the site for transparency. They are starting points, not fixed quotes. The final number for any engagement lands after the discovery call, depends on scope, and is confirmed in writing in the Statement of Work before any work begins.

8. Third-party links and tools

The site links to third-party tools, articles, and resources (LinkedIn, validator tools, blog references, partner directories). I'm not responsible for the content, accuracy, or practices of those third parties. Check their terms before using them.

9. Availability

I aim to keep the site available 24/7, but no website is up 100% of the time. There may be downtime for maintenance, hosting issues, or events outside my control. I'm not liable for any loss caused by site downtime.

10. Disclaimers

The site and its content are provided "as is" without warranties of any kind, express or implied. To the extent permitted by law, I make no warranties about:

  • The accuracy, completeness, or currency of the content.
  • That your use of the content will produce specific results (SEO rankings, AEO citations, pipeline, revenue).
  • That the site will be uninterrupted, error-free, or virus-free.

Marketing results depend on many factors outside any one operator's control. Past results (mine or any client's) don't guarantee your results.

11. Limitation of liability

To the maximum extent permitted by law, neither I nor Cut the Waffle will be liable for any indirect, consequential, special, or incidental losses, including loss of profits, revenue, data, or business opportunities, arising from your use of the site or its content.

For paid client work, separate liability terms apply under the Services Agreement.

Nothing in these terms excludes or limits liability that cannot be excluded by law - including under the NZ Consumer Guarantees Act 1993, the Fair Trading Act 1986, or equivalent consumer protection laws in your jurisdiction.

12. Privacy

How I handle personal information is covered in the Privacy Policy. By using the site, you agree to that policy as well.

13. Governing law

These terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand, unless required otherwise by local consumer protection laws.

14. Changes to these terms

I may update these terms from time to time. The "Last updated" date at the top changes accordingly. For material changes that affect existing clients, I'll communicate directly. Continued use of the site after a change means you accept the new terms.

15. Severability

If any part of these terms is found to be unenforceable, the rest still applies. The unenforceable bit gets replaced with the closest enforceable version of what was intended.
